GST LUT Form for Exporters

The GST LUT (Letter of Undertaking) is a document that allows exporters to carry out their export transactions without the requirement to pay Integrated Goods and Services Tax (IGST) at the time of supply. By filing the LUT, exporters can enjoy a smooth and tax-efficient export process, avoiding the burden of upfront tax payments.

Who Can File a GST LUT?

Any registered taxpayer involved in the export of goods or services can file a GST LUT. This option is available to those:

  • Exporting goods or services without the payment of IGST.
  • Supplying goods to SEZs (Special Economic Zones) without paying IGST.

Eligibility Criteria for LUT Registration

Exporters can apply for a Letter of Undertaking (LUT) to export goods or services without paying IGST upfront. The eligibility criteria for LUT registration under GST are as follows:

  1. Registered Taxpayers:
Any taxpayer who is registered under GST and engaged in exporting goods or services, or supplying to SEZ units, can apply for LUT.

  2. No Criminal Proceedings:
The exporter must not have been prosecuted for any offense under the GST law or other existing laws where the amount of tax evaded exceeds ₹250 lakh.

  3. Exporter of Goods or Services:
Exporters dealing in goods or services (or both) without the payment of integrated tax can apply for LUT.

  4. Prior Compliance:
The applicant should have a clean record in terms of GST compliance, meaning no major defaults or dues under the GST Act.

If these criteria are met, the exporter is eligible to file the LUT and avoid upfront payment of IGST, easing the export process.
